چکیده
تعدد و تفاوت در ماهیت جهات نقض رای بدوی یکی از پیچیده ترین مسائل آیین دارسی فرجامی است که علاوه برآن که در تشخیص صحیح «ماهیت» جهت نقض و تطبیق آن با جهات مذکور در ماده 371 قانون آیین دادرسی مدنی دارای اهمیت است، این مسئله را نیز مطرح می کند که در فرضی که دیوان عالی کشور رایی را به دو جهت متفاوت نقض می کند – یکی «نقص تحقیقات» که مطابق بند الف ماده 401 قانون آیین دادرسی مدنی پرونده به دادگاه صادرکننده رای بازمی گردد و دیگری «اشتباه در تطبیق با قانون یا نقض قواعد دادرسی» که پرونده به مرجع همعرض باید ارجاع شود – کدام مرجع صلاحیت رسیدگی خواهد داشت ؟ رای مورد نقد، در تعیین «ماهیت» جهات نقض و استناد به بندهای ماده 371 قانون آیین دادرسی مدنی با ایراد جدی مواجه است. علاوه برآن، رعایت اصول دادرسی عادلانه، اصل بی طرفی عینی، اصل صلاحیت دادگاه همعرض و استثنائی بودن صلاحیت دادگاه صادر کننده رای نقض شده در رسیدگی های فرجامی و تامین اعتماد عمومی شهروندان به قضاوت بی طرفانه، صلاحیت دادگاه تالی همعرض را در فرض تعدد جهات نقض در فرجام ایجاب می نماید.

چکیده English

The multiplicity and differences in the nature of the grounds for quashing a trial court judgment constitute one of the most complex issues in cassation procedure. In addition to the importance of correctly determining the “nature” of a ground for quashing and matching it with the grounds set forth in Article 371, this issue also raises the question of which court has jurisdiction where the Supreme Court quashes a judgment on two different grounds the case must be referred to a court of coordinate jurisdiction. despite the judgment’s strength in identifying instances of incomplete investigation, it suffers from a serious defect in determining the “nature of the grounds for quashing” and in invoking the relevant paragraphs of Article 371 of the Code of Civil Procedure. Furthermore, observance of the principles of fair trial, objective impartiality, the principle of jurisdiction of a court of coordinate jurisdiction, the exceptional nature of the jurisdiction of the court that rendered the quashed judgment in cassation proceedings, and the need to maintain public confidence in impartial adjudication require that, where multiple grounds for quashing exist in cassation proceedings, jurisdiction should lie with a lower court of coordinate jurisdiction.
