تحلیل پیوند متقابل «دعوای اصلی: الزام به تنظیم سند رسمی» و «دعوای متقابل: اعلام فسخ معامله» در پرتو دکترین تجزیه ناپذیری دعواها( تحلیلی بر دادنامه شماره ۹۵۰۹۹۷۰۹۰۹۱۰۰۴۰۴ تاریخ 3/8/1395 شعبه سوم دیوان عالی کشور)

چکیده
در دادرسی مدنی، مدیریت دعواهای مرتبط تبیین مرز میان «ارتباط ساده» و «ارتباط کافی» و «ارتباط کامل و تجزیه‌ناپذیری» دعواها، از بحث های قابل تامل است. مسئلهٔ اصلی این پژوهش، واکاوی رابطهٔ حقوقی میان دعوای «الزام به تنظیم سند رسمی » و دعوای متقابل «تایید فسخ قرارداد» است. این مقاله با تکیه بر تحلیل دادنامهٔ شمارهٔ ۹۵۰۹۹۷۰۹۰۹۱۰۰۴۰۴ صادره از شعبهٔ سوم دیوان عالی کشور، و با روش توصیفی-تحلیلی، ضمن تحلیل رویکرد دادرسان، به بررسی پیامدهای آیینی این پیوند می‌پردازد. یافته‌های پژوهش نشان می‌دهد رابطهٔ این دو دعوا از مرز ارتباط ساده و کافی فراتر رفته و به دلیل امتناع عقلی و عملیِ جمع میان اجرای تعهدات ناشی از عقد (انتقال سند) و انحلال آن (فسخ)، واجد وصف «ارتباط کامل» و «یگانگی آیینی» است. از این رو، رسیدگی توأمان و صدور تصمیم واحد، نه امری تخییری برای دادرس، بلکه تکلیفی آمره است. همچنین به اقتضای تقدم منطقی-آیینی، رسیدگی به ادعای فسخ بر دعوای الزام تقدم رتبی دارد، زیرا استحقاق مطالبهٔ سند، فرع بر احراز بقای رابطهٔ قراردادی است. اثر وضعی این تجزیه‌ناپذیری در مرحلهٔ اعادهٔ دادرسی نیز هویداست؛ به‌گونه‌ای‌که هرگونه تغییر در موقعیت حکمی دعوای فسخ در این مرحله، سرایتی قهری بر سرنوشت دعوای اصلی خواهد داشت.

An Analysis of the Interdependence Between the “Principal Action for Specific Performance” and the “Counterclaim for Contract Rescission” in Light of the Doctrine of the Indivisibility of Actions

چکیده English

In civil procedure, managing related claims—specifically delineating the boundaries between “simple connection,” “sufficient connection,” and “complete connection and indivisibility”—remains a subject of complex debate. The central issue of this study is to examine the legal relationship between the “Action for Specific Performance” (to register an official deed) and the “Counterclaim for Contract Rescission”.” Adopting a descriptive-analytical methodology and focusing on Supreme Court Ruling No. 9509970909100404 (Branch 3), this paper critiques current judicial approaches and explores the procedural implications of this nexus.



The findings demonstrate that the relationship between these two claims transcends “simple” or “sufficient” connection. Due to the logical and practical impossibility of reconciling performance (transfer of title) with termination (rescission), this relationship constitutes “complete connection” and “procedural unity.” Consequently, simultaneous adjudication and the issuance of a unified decision are not merely discretionary for the court; they are imperative duties mandated by the principles of procedural fairness. Furthermore, due to “logico-procedural priority,” the claim for rescission must be adjudicated prior to the action for specific performance, as the latter is contingent upon the continued validity of the contract.
