Commentary on the Judgment of Branch Three of the Supreme Court of Iran (Judgment No. 9509970909100162): An Analysis of the Scope of Jurisdiction in Third-Party Objection to a Judgment of Incapacity (Hajr)

Abstract
his note analyzes a judgment rendered by Branch Three of the Supreme Court of Iran in a case concerning a third-party objection to judicial decisions relating to the legal incapacity ( حجر ) of an individual. The central issue of the analysis is the distinction between the judgment issued by the court determining the individual’s incapacity and the decision rendered by the appellate court concerning the third-party objection, and, consequently, the determination of the competent judicial authority to hear and adjudicate the objection.



Alongside this procedural and jurisdictional issue, the judgment raises several substantive questions, including the nature of legal incapacity as a matter of ḥesbi jurisdiction (non-contentious proceedings), the declaratory nature of a judgment of incapacity, the manner in which the commencement date of incapacity is determined, the evidentiary value of a medical expert’s opinion, and the role of the presumption of continued soundness of mind and absence of incapacity.An examination of the judgment indicates that, before addressing the merits of the claim and evaluating the medical evidence, it is necessary first to identify the actual subject matter of the third-party objection and determine which judicial decision has directly prejudiced the legal rights of the third-party objector.
